Death Benefits & Compensation for Fatal Work Accidents
Georgia’s workers’ compensation act allows families to receive benefits when their loved one dies in a work-related accident. Death benefits are also available in the event when a worker dies as a result of occupational illness.
Here are a few details about Georgia’s workers’ comp death benefits:
- In order to recover benefits, it must be shown that the death results in the course of employment – the same standard for any workers’ compensation claim. In cases where the reason of death is unknown, it will be presumed that it occurred in the course of employment if the employee was located where they would have likely been performing work duties.
- Death benefits are available to the dependents of a worker, which often includes surviving spouses, children, or dependent stepchildren.
- Dependents are entitled to receive 2/3 of a worker’s average week rate, or a maximum of $575 per week. Under Georgia law, this applies to deaths that occur on or after July 1, 2016.
- State law caps benefits for widowed spouses to a total of $230,000. If the spouse remarries or cohabitates with a new partner, benefits will no longer be paid.
- If there are children, surviving spouses are entitled to death benefits until the age of 65, or for up to 400 weeks, regardless of the $230,000 cap. Children may also receive benefits until the age of 18, or the age of 22 if they are enrolled full time in school. Children with disabilities that prevent them from working can receive benefits for as long as they are dependent.
