3 Common Lies From Insurance Companies After an Injury
Becoming injured in a work accident is never ideal, and going through the workers’ compensation claims process can make it even more challenging. Unfortunately, insurance companies may lie or misrepresent important information to avoid making larger payouts, and this can leave you with less compensation than you deserve.
If needing to pursue an injury claim, it’s essential to be able to recognize misinformation and understand how this can be harmful. Here are three of the most common lies to be aware of.
1. You Have to Give a Recorded Statement
Giving a recorded statement is one way that insurance companies try to trip up injured workers. They may tell you that this is necessary or a requirement for your claim, but this isn’t always true. More often than not, a recorded statement will be used against you throughout the process.
It is always in your best interest to consult with a workers’ compensation attorney before giving any recorded or written statement to the insurance company.
2. You Have to Go to a Specific Doctor
In some cases, insurance companies will try to dictate which doctor you see for your injuries. They may have a list of approved medical facilities and physicians that they will only pay for treatment from. However, you generally have the right to choose your own doctor after a workplace injury.
The exception to this is if the insurance company is requesting an independent medical evaluation (IME). While this will not affect your treatment plan since it is typically just a general evaluation, it may be used as a second opinion to prove the severity of the injury.
3. You Were At Fault and Cannot Recover Compensation
Based on the report of the incident, the insurance company may try to tell you that you cannot receive compensation because you were partially at fault for your injuries. This is false — Georgia operates on a no-fault workers’ compensation system, meaning that you can pursue compensation for nearly any work injury.
